DUI Suspensions

There are two type suspensions that can result from a DUI case.  They are independent of each other. The first is the Administrative Suspension. This is not a criminal suspension. The Administrative Suspension begins once you get a citation or notice from the Bureau of Administrative Review. You only have 10 days to challenge that suspension, the citation advises you about this strict time limitation. Basically, the State of Florida is going to take away your license privilege because you either refused to give a breath test or you submitted to a test and your alcohol level was above .08, the legal limit in Florida.  If you are convicted of a DUI in Florida as part of your sentence an additional suspension will occur. 

ADMINISTRATIVE SUSPENSIONS & HARDSHIP LICENSE ELIGIBILITY

First Refusal: 1 year suspension

Second Refusal: 18 month suspension (Not eligible for a Hardship License for Second Refusal).

First Breath Result above (.08): 6 month suspension

Second Breath Result above (.08): 1 year suspension

CRIMINAL SUSPENSIONS & HARDSHIP LICENSE ELIGIBILITY

First Criminal Offense: 6 months to 1 year suspension

Hardship Eligibility: In order to be considered for a hardship license you must
show completion of DUI school.

Second Criminal Offense (Outside) of Five years: 6 months to 1 year

Hardship Eligibility: You must serve out the criminal suspension before you can reinstate

Second Criminal Offense (Inside) of Five years: 5 year suspension

Hardship Eligibility: you must wait 1 year before applying for Hardship License

Third Criminal Offense (Outside) of Ten years: 6 months to 1 year

Hardship Eligibility: you must serve out the criminal suspension before you can reinstate

Third Criminal Offense (Inside) of Ten years: 10 year suspension

Hardship Eligibility: you must wait 2 years before you may apply for a Hardship License

Fourth Criminal Offense: Permanent Revocation.

Hardship Eligibility: Currently Florida law does not provide for the possibility of a Hardship License.
